Dothan, Alabama Lawyers File Lawsuit on Behalf of Two Local Realtors
Dothan, Alabama lawyer Aaron Gartlan of Gartlan Injury Law have filed a lawsuit in the Circuit Court of Houston County with a jury demand against a Dothan real estate company and two local businessmen on behalf of the two good hard-working Dothan realtors for breach of contract.
The lawsuit basically alleges that on December 27, 2007, the realtors entered into an agency relationship and agreement with this Dothan Real Estate company to provide services as real estate sales associates, and while serving in that capacity, they solicited various real estate service agreements on listings and are entitled to commissions from the sale of the listings. The lawsuit further contends that the Realtors spent great amounts of time marketing, contacting potential customers, conducting negotiations, conveying offers, and attending closings, and that they have invested considerable sums of their money on promotional and marketing costs, including internet advertising, open house showings, digital billboards, virtual internet tours, aerial photographers, leasing airplanes, office expenses and the like, in order to procure and sell the listings. The complaint for damages also contends that the Realtors established business relationships with the customers in the course of conducting the sales and marketing activities.
Additionally, the lawsuit avers that on September 9, 2011, the Realtors terminated the agency relationship and agreement with this Dothan real estate company and established an agency relationship with another local real estate company to provide services as real estate sales associates, and that at the time they terminated the relationship and agreement they had procured about sixteen unsold listings for the previous Dothan real estate company. Moreover, the complaint for damages alleges that the previous Dothan real estate company was required pursuant to the agency agreement to promptly release and assign these listings to the Realtors in exchange for a twenty-five percent referral fee to be paid by the Realtors upon the sale of the listings, and that the previous Dothan real estate company has refused to release and assign these listings and has instead assigned many of them to be serviced by other agents of the previous Dothan real estate company. Furthermore, the lawsuit accuses the previous Dothan real Estate Company has even accepted offers to buy or sell some of these listings to the exclusion of the Realtors.
This has damaged the Realtors in excess of $50,000.00 in withheld commissions and has prevented them from fulfilling their agreements to market real estate for their customers, thereby damaging the relationships between the Realtors and their customers, depriving them of business and referral, according to the complaint for damages.
