Dothan Alabama Personal Injury Attorney Settles Motorcycle Wreck Without Filing Lawsuit
Dothan Alabama Personal Injury and Accident Lawyer Aaron Gartlan of Gartlan Injury Law settled a claim with US Agencies Insurance Company on behalf of a good hardworking Pike County Alabama man for injuries and damages sustained in a motorcycle accident through no fault of his own. The man was rear-ended while stopped at a traffic light waiting in Troy Alabama and was very fortunate his injuries were not permanent or life threatening.
Shortly after the collision, he began to feel pain in his lower back. So he went to the local emergency room where x-rays were ordered. The clinical impression was a lumbar sprain and pain medication was prescribed.
A few days later, he went to a family physician still experiencing back pain. The doctor diagnosed him with lumbago, prescribed pain medication and recommended moist heat, gentle range of motion, to not lift anything over five pounds for a week and physical therapy if the pain was not alleviated in two to four weeks. This really limited his ability to work and caused him to miss approximately over two weeks of work hours, which is very important to him.
After about two and a half weeks, he returned to the family physician with back pain especially in the mornings and reported that the medications were helping. The doctor continued him on the same course of treatment and instructed that she would refer him to physical therapy if he was not better in two weeks.
In a month, he was still suffering with back pain, specifically in the morning and late at night. Therefore, the family physician prescribed him physical therapy.
He then completed eight sessions of physical therapy in an effort to get relief and saw the family physician toward the end of the following month. His back was much better at that time.
Just short of two months after that visit, he had another appointment with the family physician, as the back pain had set in again and was prescribed pain medication.
The vast majority of his medical bills were taken care of by his Blue Cross Blue Shield health insurance and his GEICO med pay. However, he was facing the subrogation claims from these two insurance companies.
He had completed his treatment and was attempting to settle the case himself about ten months after the motorcycle wreck and became frustrated when he came to my law firm. The hard working man wanted and deserved honest advice and guidance. He wanted to know if it was even worth dealing with.
The personal injury and accident lawyers at the Gartlan Injury Law certainly prefer to see a client and begin the representation right after a wreck, because personal injury and accident cases can be like a mine field filled with facts and circumstances that can explode into issues that will drastically impact the value of the case. Aaron Gartlan was still honored to see and represent him at that time, even though his injuries and damages were not as extensive compared to some of the other cases at the law firm. It was most certainly a case worth handling.
The claim was settled with US Agencies without filing suit. Aaron Gartlan and the Law Firm went to work and obtained all of the medical records and bills as well as other important documents and made a demand on the insurance company which summarized the injuries and damages. This resulted in a successful negotiated settlement without filing a lawsuit with US Agencies on behalf of the driver that caused this man’s injuries and damages.
Aaron Gartlan and the Firm also entered into an agreement with the Blue Cross Blue Shield, GEICO and the medical providers to pay a reduced amount of the outstanding subrogation interest and medical bills, which ensured the man received more money and the medical bills were paid.
